IRS Eliminates 5% Safe Harbor Rules, Physical Work for Energy Credits

After the OBBB and IRS Notice, wind and solar projects are now under stricter tax credit rules. Developers must construct before July 4, 2026, rely on physical work, and maintain progress as the 5% safe harbor gets removed.

Experts urge documentation and early tax planning to avoid disqualification. With off-site manufacturing getting less viable, on-site work is becoming essential to meet the IRS’s new “facts-and-circumstances” standards.
